Terms of Service
These Terms of Service govern the purchase of the guided bike experiences that Cycling Experience organises in Umbria. You accept them when you pay, together with the Privacy Policy: from that moment they are part of the contract between you and us. They are written to be read: if anything is unclear, write to us before you buy and we will explain it.
1. Who we are
The service is organised and sold by:

A.S.D. CIEMME is affiliated with the Federazione Ciclistica Italiana (FCI), the Italian cycling federation.
In this document «Cycling Experience», «the organiser» and «we» mean A.S.D. CIEMME; «you» means the person buying the experience. The experiences are led by guides who know the area and are appointed by the organiser.
These Terms are also published in Italian: in the event of any discrepancy between the two versions, the Italian text prevails.
2. What the contract covers
The contract covers a guided bike experience on an agreed route in Umbria: a guide accompanying you along the itinerary, plus the services listed in the proposal we sent you.
Every experience takes place within a single day, half a day or a full day, and ends on the day it begins. Overnight stays are not included and we do not organise multi-day experiences. We do not offer self-guided routes: every ride is accompanied by a guide.
For this reason what you buy is not a package holiday: art. 32, comma 2, lettera a) del Codice del Turismo (legislative decree 79/2011, the Italian tourism code) expressly excludes from the package travel rules any tourist service lasting less than twenty-four hours that does not include an overnight stay. The rules on packages and linked travel arrangements therefore do not apply to our experiences.
Getting to the meeting point and back under your own steam is not part of the service, nor are services you buy directly from someone else during the day.
3. The nature of the relationship
You buy a service as a consumer, that is, for purposes outside any business or professional activity: you have all the protections that the Codice del Consumo, the Italian consumer code, grants to consumers.
A.S.D. CIEMME is a sports association, but you do not have to join it or take out any membership to take part. We do not ask you to become a member, we do not ask for a membership fee, and taking part is not conditional on holding a sports federation card: you pay for a service and you get a service.
The account you create on the site exists only so you can follow your request, receive the proposal, choose the extras and talk to us while the experience is being organised.
4. How the contract is concluded
The path is always the same, and it runs entirely through the website. Bookings are made exclusively online: we do not accept bookings by phone, email or messaging apps. Those channels exist for support (asking questions, getting clarifications, sorting out a problem), not for booking.
The quote request
You fill in the form on the site, telling us how many of you there are, your level, the area, the date and the part of the day you prefer. The request is free and non-binding: it is not an order, it creates no obligation to pay, and it commits neither of us.
Our proposal
A person reads your request and prepares a proposal for you, which you receive in your account area. The proposal states the total price and the price per person, the route with its stops, the service level, which extras are included and which you can add, the number of participants, the date, and the date until which the proposal is valid: normally ten days from when it is sent. If you let it expire without accepting it, it lapses, and you can always ask us for a new one.
The proposal is our offer: it stands on the terms and for the period stated in it.
Acceptance and payment
If the proposal works for you, from your account area you choose the extras you want (the total updates as you choose) and you go to payment. Before paying we ask you to accept these Terms and the Privacy Policy: we record which version you accepted and when.
The contract is concluded at the moment the payment succeeds: only then is the date reserved for you. Straight afterwards you receive the order confirmation by email and you find the order in your account area, with a summary of what you bought.
5. Prices and payment
All amounts are in Euro and are inclusive of applicable taxes: the price you read in the proposal is the price you pay, and there are no costs that appear later.
The price covers only what is listed in the proposal. In particular, bike rental is not part of any service level: it is a paid extra you can add when you accept the proposal, exactly like lunch, a photo service or a transfer. If you have a bike, bring it; if you do not, you can rent one from us by paying the corresponding extra.
How you pay
Payment is made by credit or debit card through SumUp, the provider that handles the transaction. You enter your card details on the provider's pages and they never pass through our systems: as explained in the Privacy Policy, we neither see nor store your card number.
The amount is collected in full by A.S.D. CIEMME, which delivers the whole service: you pay a single amount to us, and you do not pay the guides or the other suppliers involved in the day separately.
The two options
- Pay in full now. You pay the whole amount and we apply the discount stated in the proposal, normally 10%.
- Deposit now, balance on the day. You pay online the percentage stated in the proposal, normally 30%, and you pay the balance in cash on the day of the experience, before departure. The exact balance is written in the proposal and in the order summary.
Which of the two to use is your choice at the time of payment: the proposal shows both figures so you can compare them.
6. Right of withdrawal
This section is about a right you would normally have when buying online and which does not exist here: please read it before paying.
When you buy at a distance, the Codice del Consumo normally gives you fourteen days to change your mind and get a refund, without having to explain why. For the experiences we sell that right does not apply, because art. 59, comma 1, lettera n) del Codice del Consumo (legislative decree 206/2005) excludes it for contracts concerning leisure activities to be performed on a specific date. Our experiences are exactly that: a bike ride booked for a particular day, with a guide who works for you that day and not for anyone else.
In practice: once you have paid for an experience on an agreed date, you cannot cancel the contract within fourteen days and get an automatic refund, the way someone who bought an object and sent it back can.
The exclusion comes from the law, not from these Terms: it applies to this type of contract, and it is not something we are asking you to agree to. What the law asks of us is to inform you before you pay, and this section is that information.
Withdrawal is one thing; being able to call it off is another. What you can do is described in the next section and remains valid: cancel by the seventh day before and get a full refund, move the date when the cancellation is ours, have someone take your place. Those are contractual conditions we offer you, not the statutory right described above.
7. Cancellations and refunds
The conditions below are our contractual conditions: they apply in addition to your statutory protections, not instead of them.
If you cancel
What counts is the moment we receive your written notice, which you can send to info@cyclingexperience.it or through the messages in your account area: both count the same. The days are counted against the date of the experience. There is a single dividing line: the seventh day before.

The refund reaches you by the same payment method you used, within fourteen calendar days of your notice. If you chose the deposit option, we return what you actually paid online.
You can send someone in your place. If you cannot come but someone else can take your place, tell us in writing before the date: the person replacing you takes part on the same terms and you lose nothing of what you paid. It is the best solution when there are fewer than seven days left and the refund is gone.
If we cancel
It can happen, for reasons that have nothing to do with you: weather that would make the ride unsafe, a guide suddenly unavailable, an event beyond our control. In that case you choose between:
- a full refund of what you paid, by the same payment method and within fourteen calendar days of our notice;
- an alternative date, agreed with us, on the same financial terms.
We tell you as soon as the decision is made, by the fastest means available to us: normally a phone call, followed by an email putting in writing the choice we are offering you.
8. Participant obligations
Physical fitness
By taking part you declare that you are in good health and in a physical condition suited to riding the agreed distance and elevation gain. This is your own declaration: we do not ask you for health documentation, we do not put you through medical questionnaires and we do not record any information about your health, as explained in the Privacy Policy.
For the same reason, the level you declare in the quote request (beginner, intermediate, advanced) must match how much you actually ride: it is what we use to set the route, the pace and the stops.
Alongside fitness, basic bike handling is needed: being able to start and stop safely, hold your line, manage a descent, ride in a group without putting the person next to you in difficulty. Fitness and bike handling are assessed by the guide at the initial briefing, before departure. When what the guide sees at the meeting point or along the way calls for it, they may step in: adapt the route, shorten it, or exclude from the ride anyone who is in a dangerous situation for themselves or for others.
If we exclude you from the ride (for insufficient fitness or bike handling, for not having a helmet, for a bicycle in an unsafe condition), we refund in full what you paid, by the same payment method and within fourteen calendar days. We do not treat it as a no-show.
We recommend carrying, in an easy-to-find pocket, a card with your full name, at least three numbers to call in an emergency, your blood type, any ongoing medical conditions, any treatment you are on and any drug allergies. That card stays with you: it is there for whoever comes to your aid, not for us. We do not ask you to hand it over or to tell us what is on it.
Helmet and bicycle
A helmet is compulsory and must be worn for the whole ride: no helmet, no departure.
If you ride your own bike, you must turn up with a machine in a condition suited to the route: brakes that work, tyres in order, a working drivetrain, and lights when they are needed. If you rent a bike from us (the paid extra described in section 5), you use it following the instructions given at the initial briefing.
For safety reasons the guide may exclude from the ride a bicycle in a condition they consider unsafe, or a participant without a helmet. We do what we can to find a solution on the spot, but the safety of the group comes first.
Conduct during the ride
You undertake to:
- arrive at the meeting point on time, at the agreed hour;
- turn up with suitable clothing and equipment for the route and the season: this is not a formality, a day in the saddle with the wrong kit gets long for you and for the group;
- comply with the Codice della Strada, the Italian highway code: on a bike you are driving a vehicle and you are answerable for it;
- follow the guide's instructions throughout the ride;
- stay with the group, without leaving the agreed route and without overtaking the guide;
- cooperate with the guide and report any problem immediately: feeling unwell, a mechanical fault, dangerous behaviour by anyone in the group;
- behave respectfully towards people, animals and private property;
- not pick flowers, plants or protected species;
- carry your rubbish with you until the first suitable bin.
Minors
To request a quote, accept a proposal and pay, you must be of age, that is, at least 18.
Minors may take part, accompanied by an adult: a parent, the legal guardian, or an adult holding written authorisation from whoever has parental responsibility, to be handed over before departure. During the experience the minor remains under the supervision and responsibility of the accompanying adult, who must assess whether the agreed route is suitable for them and watch over their behaviour on the road. That supervision does not reduce our own obligations: the organiser remains bound to perform properly what it undertook to do, and is liable for it on the terms set out in section 9.
Photos and video
Photos and video may be taken during the ride, including for promotional purposes. Taking part does not mean consenting to publication: consent is optional, it is given separately and it can be withdrawn at any time, as described in the Privacy Policy. If you would rather not appear, tell the guide: that is all it takes.
9. Liability
How we are liable
A.S.D. CIEMME is liable for the proper performance of the obligations it takes on under the contract (organising the ride, providing you with a guide, delivering the services listed in the proposal) and for any damage under the applicable law.
You will not find in these Terms a clause excluding or limiting our liability for personal injury, and that is not an oversight: towards a consumer, such a clause would be void under art. 1229 del codice civile (the Italian civil code) and art. 33, comma 2, lettera a) del Codice del Consumo. We preferred to say so, rather than write something that would have no effect.
What you are liable for
You are liable for damage you cause to us, to other people in the group or to third parties where it results from:
- your own carelessness or negligence, or from breaking the rules of the road;
- failing to follow the instructions given by the guide;
- physical conditions or limitations you did not declare, where knowing about them would have changed the route or the way it was led;
- improper use of equipment we made available to you.
Harm suffered by you is dealt with by the law, not by this contract: where your own conduct played a part in causing it, the consequence is the one set by art. 1227 del codice civile, the civil code provision on the injured party's contributory fault. No clause in these Terms puts the harm you suffer on you.
Rented equipment: damage and theft
If you rent a bike or other equipment from us, you are answerable for it while it is in your hands.
On your return the guide checks the condition of the equipment in your presence. If there is damage, they document it with photographs and give you an estimate of the repair costs within five working days. You can dispute the estimate within seven days of receiving it by writing to info@cyclingexperience.it: we reply within ten working days.
In the event of theft you must report it to the authorities within forty-eight hours and give us a copy of the report.
Your own situation
The price of the experience does not include any form of financial protection in the event of an accident, either for you or for damage you might cause to others: the organiser provides none.
Before taking part, check for yourself what personal cover you have (for example whatever may come from a sports federation card you already hold, from a contract you have signed, or through your household) and arrange it if you think it appropriate. It is your call to make, and we invite you to make it calmly before booking, not on the day of the ride.
Safety during the experience
The guide may change the route, shorten it or call it off when they judge it necessary for the safety of the group: a change in the weather, the state of a road, the condition of a participant. It is a technical decision that is theirs to make, and safety comes before the programme.
10. Jurisdiction and governing law
The contract is governed by Italian law.
For disputes involving a consumer, the court of the place where the consumer is resident or domiciled by election has jurisdiction, under art. 66-bis del Codice del Consumo. That jurisdiction cannot be contracted out of: we do not depart from it and we do not ask you to.
These Terms contain no choice-of-court clause: no location is named as the exclusive place for legal proceedings, because towards a consumer a clause of that kind would have no effect.
Any provision of the Codice del Consumo that is more favourable to the consumer prevails over what is written in these Terms.
11. Complaints and dispute resolution
If something has gone wrong, we are the first channel: write to info@cyclingexperience.it giving your order reference and what happened. We get back to you within ten working days; when we need longer to look into it, we tell you straight away and say how long we need.
If we cannot reach an agreement, you can turn to an alternative dispute resolution (ADR) body among those listed by the competent authorities, under articoli 141 e seguenti del Codice del Consumo, the consumer code provisions on out-of-court dispute resolution: it is a faster and cheaper procedure than going to court. If you want to get your bearings first, the European Commission maintains an information page on the redress available to consumers, including the list of national ADR bodies, at https://consumer-redress.ec.europa.eu. It is an information page, not a place to file a complaint.
Turning to an ADR body is an option, not an obligation: you can always go straight to the court identified in section 10.
12. Changes to these Terms
These Terms may change, for example if our payment methods or the services we offer change. Every version is numbered and dated: the version number and the date of the last update are shown at the top of this page, and earlier versions remain tracked in the history of our source code.
Substantial changes (those that materially affect your rights, the price or the cancellation conditions) are announced on this page with at least thirty days' notice and communicated by email to registered users before they take effect. For minor changes, such as a wording clarification, we simply update the page.
What you have already bought does not change. Every order remains governed by the version of these Terms in force at the moment you paid: at checkout we record which version you accepted and when, and that is the version that applies to that order.
